Welcome to Kingma Lumber. By accessing our website, making a purchase, or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully.
1. ACCEPTANCE OF TERMS
By placing an order with Kingma Lumber, whether online, in-store, or by phone, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services or purchase our products.
2. DEFINITIONS
"Company," "we," "us," or "our" refers to Kingma Lumber, located in Edmonton, Alberta, Canada.
"Customer," "you," or "your" refers to the person or entity purchasing products or services from Kingma Lumber.
"Products" refers to all lumber, woodworking materials, tools, and related items sold by Kingma Lumber.
3. PRODUCT INFORMATION AND PRICING
3.1 All product descriptions, specifications, and images are provided as accurately as possible. However, we do not warrant that product descriptions, pricing, or other content on our website is accurate, complete, reliable, current, or error-free.
3.2 We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.
3.3 All prices are subject to change without notice. Prices listed are in Canadian Dollars (CAD) unless otherwise specified.
3.4 We reserve the right to limit quantities purchased and to refuse service to anyone at our sole discretion.
4. NATURAL MATERIALS
4.1 Wood is a natural product. Variations in grain, color, texture, and characteristics are inherent to wood and should be expected. Such variations are not considered defects.
4.2 Customers are responsible for inspecting all lumber and wood products before use. Wood may expand, contract, warp, or change appearance due to environmental conditions, which is not covered under any warranty.
4.3 All wood products are sold "as is" unless otherwise specified in writing.
5. ORDERS AND PAYMENT
5.1 All orders are subject to acceptance by Kingma Lumber. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.
5.2 Payment is due at the time of purchase unless credit terms have been established in writing.
5.3 We accept various forms of payment as posted in-store and online. All credit card transactions are subject to verification and authorization.
5.4 A deposit may be required for special orders or large purchases. Deposits are non-refundable unless we are unable to fulfill the order.
6. MEMBERSHIP BENEFITS
6.1 Membership benefits, including discounts, are subject to the terms of the membership program and may be modified or discontinued at any time.
6.2 Membership discounts cannot be combined with other promotions unless explicitly stated.
6.3 Membership privileges are non-transferable.
7. SPECIAL ORDERS
7.1 Special orders require a non-refundable deposit and are not eligible for return or refund once ordered.
7.2 Lead times provided for special orders are estimates only. Kingma Lumber is not responsible for delays caused by suppliers, manufacturers, shipping companies, or circumstances beyond our control.
7.3 Customers must inspect special order items upon arrival and report any discrepancies within 48 hours.
8. DELIVERY
8.1 Delivery fees are calculated based on distance, order size, and accessibility. Delivery estimates are approximate and not guaranteed.
8.2 The customer is responsible for ensuring adequate access for delivery vehicles. Additional charges may apply if access is restricted or if special equipment is required.
8.3 Kingma Lumber is not liable for delays in delivery caused by weather, traffic, equipment failure, or other circumstances beyond our reasonable control.
8.4 The customer assumes all risk of loss or damage to products upon delivery. It is the customer's responsibility to inspect all delivered products immediately upon receipt.
8.5 Unloading is the customer's responsibility unless otherwise arranged and paid for in advance.
9. RETURNS AND REFUNDS
9.1 Returns are accepted within 30 days of purchase with original receipt and in original condition. Products must be unused, undamaged, and in their original packaging.
9.2 Custom-cut items, special orders, clearance items, and lumber that has been cut to size are NOT eligible for return or refund.
9.3 A restocking fee of 20% may be applied to all returns.
9.4 Refunds will be issued to the original method of payment. Processing time may take 7-14 business days.
9.5 We reserve the right to refuse returns that do not meet our return policy requirements.
10. PICKUP AND WILL-CALL ORDERS
10.1 Will-call orders must be picked up within 14 days of notification. After 14 days, orders may be restocked, and a restocking fee of 20% will be applied.
10.2 Customers are responsible for loading their own vehicles unless loading service has been arranged and paid for.
10.3 Kingma Lumber is not responsible for damage to customer vehicles during loading.
11. LIMITATION OF LIABILITY
11.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINGMA LUMBER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.
11.2 Our total liability to you for any claim arising out of or relating to these Terms or your use of our products shall not exceed the amount you paid for the specific product giving rise to the claim.
11.3 Kingma Lumber is not responsible for any damages, injuries, or losses resulting from the improper use, installation, or handling of our products.
11.4 We are not liable for project delays, cost overruns, or consequential damages resulting from product defects, delivery delays, or any other cause.
12. WARRANTY DISCLAIMER
12.1 ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
12.2 Kingma Lumber disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12.3 We do not warrant that products will meet your requirements or that they will be suitable for any particular purpose.
12.4 Any manufacturer warranties are the sole responsibility of the manufacturer. Kingma Lumber does not extend or modify manufacturer warranties.
13. INSPECTION AND ACCEPTANCE
13.1 Customers must inspect all products at the time of purchase or delivery. Any visible defects, shortages, or damages must be reported immediately before leaving the premises or before the delivery driver departs.
13.2 Failure to inspect and report issues immediately constitutes acceptance of the products in their delivered condition.
13.3 Claims for shortages, damages, or defects made after departure from our premises or after delivery acceptance will not be honored unless previously documented.
14. CUSTOMER RESPONSIBILITY
14.1 Customers are responsible for determining the suitability of products for their intended use.
14.2 Customers are responsible for ensuring compliance with all applicable building codes, regulations, and safety standards.
14.3 Customers should consult with qualified professionals regarding the appropriate selection and use of products.
15. INTELLECTUAL PROPERTY
15.1 All content on the Kingma Lumber website, including text, graphics, logos, images, and software, is the property of Kingma Lumber and is protected by Canadian and international copyright laws.
15.2 You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.
16. PRIVACY
16.1 Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
16.2 We collect and use personal information as described in our Privacy Policy.
17. FORCE MAJEURE
17.1 Kingma Lumber shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, supplier failures, government actions, or public health emergencies.
18. SEVERABILITY
18.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
19. GOVERNING LAW AND JURISDICTION
19.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein.
19.2 Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Alberta.
19.3 You irrevocably consent to the jurisdiction and venue of such courts and waive any objection to the laying of venue in such courts.
20. MODIFICATIONS TO TERMS
20.1 Kingma Lumber reserves the right to modify these Terms and Conditions at any time without prior notice.
20.2 Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms.
20.3 It is your responsibility to review these Terms periodically.
21. ENTIRE AGREEMENT
21.1 These Terms and Conditions constitute the entire agreement between you and Kingma Lumber and supersede all prior agreements, understandings, and communications, whether written or oral.
21.2 No waiver of any provision shall be deemed a further or continuing waiver of such provision or any other provision.
